These Terms and Conditions (“Terms”) apply to bookings made through Lie Detector Test UK. Lie Detector Test UK is a trading name of Instytut Badań Wariograficznych Adam Rangotis, a sole-trader business registered in Poland, Twarda 18, 00-026 Warszawa, Poland (email: [email protected], free helpline: 0800 861 1058).
In these Terms, Lie Detector Test UK is referred to as “we”, “our”, or “us”; the independent polygraph examiner conducting your examination is referred to as “the Examiner”; and the person making the booking and attending the examination is referred to as “I”, “Individual”, “Examinee”, or “You”.
We provide a booking and referral service. We arrange your polygraph examination with an independent, qualified Examiner. This includes scheduling the appointment, sending you the Pre-Examination Questionnaire, and acting as your point of contact until the examination takes place.
We do not conduct the examination ourselves. The examination and written report are provided by the Examiner, who is responsible for carrying out the test.
You pay us a fee of £125 for our Online Pre-Examination Assessment and booking service (the “pre-examination assessment fee”). This fee covers reviewing your Pre-Examination Questionnaire and assessing the examinee’s health and suitability for a polygraph examination, preparing the case for the Examiner, and arranging the examination with an independent, qualified Examiner. This is the only payment we collect.
These are two separate services with separate fees. The total price displayed for your test consists of our £125 pre-examination assessment fee and the Examiner’s fee for conducting the examination (the “balance”). The balance is paid directly to the Examiner and is not collected or held by us.
1.1. I confirm that, as the individual ordering the examination, I have provided the participating examinee with the complete Terms and Conditions. I also confirm that every examinee participating in the examination has consented to undergo the examination.
1.2. I agree that the examinee will not be permitted to undertake the examination if they have consumed alcohol or misused substances, including drugs or controlled substances, within the 24 hours preceding the test.
1.3. I confirm that the examinee is not pregnant and has not given birth within the previous 4 weeks. I further confirm that the examinee does not have any heart conditions, including but not limited to conditions requiring blood pressure medication or the use of a pacemaker. In such circumstances, it is agreed that the examinee will seek appropriate medical advice.
1.4. I confirm that both I, as the individual placing the order, and the examinee are at least 18 years of age.
1.5. I acknowledge that where a booking is made with less than 48 hours’ notice, the full fee will be payable and all Terms will continue to apply.
1.6. When making a booking online or by telephone, the preferred examination date may be changed for any of the following reasons:
1.6.1. Poor health affecting either the subject or the Examiner.
1.6.2. Inaccessibility of a controlled office.
1.6.3. Failure of an IT device or the Polygraph Machine.
1.6.4. Other unforeseen circumstances not previously specified.
1.6.4.1. We always guarantee that the test will be conducted by an experienced expert within 10 working days of the pre-selected test date specified when the order was placed.
1.7. I confirm that the test is not connected to any illegal or criminal matter. I understand that we reserve the right to cancel the booking without issuing a refund if this is subsequently discovered to be untrue.
2.1. I understand that:
2.1.1. I must provide valid government-issued identification, such as a Photo ID Card, Passport, or Driving Licence, upon arrival for verification purposes.
2.1.2. Abuse, aggression, or threatening conduct towards any employee or affiliate of Lie Detector Test UK will not be accepted. Such behaviour will result in the examination being terminated, all fees already paid being retained, and the option to rebook being withdrawn.
2.1.3. If any employee or affiliate is exposed to criminal activity, dishonest or underhand behaviour, or an attempt to offer a bribe, they reserve the right to terminate the examination. All fees paid will be retained and the option to rebook will be withdrawn.
2.1.4. Any attempt to use countermeasures will result in one warning. Any further attempt will cause the examination to be terminated, all fees paid to be retained, and the option to rebook to be withdrawn.
2.1.5. I must arrive at the venue at least 15 minutes before the allocated appointment time. Unreasonable lateness will result in the examination being cancelled, all fees paid being retained, and the option to rebook being withdrawn.
2.1.6. Only closed-ended, issue-specific questions will be considered valid and asked during the examination. Questions concerning beliefs, opinions, or intentions cannot be asked.
2.1.7. Up to 8 questions may be asked during the examination, of which 2–3 will be closed-ended and specifically related to the issue under examination.
2.1.8. The lie detector test uses a polygraph examination to identify physical indicators of deception, together with extensive assessment by a forensic psychologist.
2.1.9. If there is any suspicion of domestic violence, the Examiner will report the matter to the relevant authorities without exception.
2.1.10. Once the examination has been completed, the Examiner will provide the person who made the booking with a complete written report of the polygraph examination. The report will be sent confidentially by email to the person who made the booking and will not normally be provided on the day of the examination unless otherwise stated.
2.1.11. No third parties are permitted to be present during the examination. However, third parties may be present during the pre-test interview.
2.1.12. A complete and detailed test report will be provided to the client by email within 24 hours of the examination being conducted, or within 48 hours if the report is sent by tracked mail, depending on the option requested by the client from the Examiner on the day of the examination. In certain circumstances, the Examiner may provide the results verbally on the day of the examination to the person who made the booking. However, the Examiner may sometimes require the charts to be reviewed by another Examiner before releasing the results, in which case the results will not be provided verbally.
2.1.13. Where the client provides the venue, the examination room must be clean and free from clutter. All surfaces must be clean and sanitised to reduce the risk of germs or viruses spreading. The room must provide complete privacy and contain 2 chairs, 1 table, and a power point for the laptop. The examinee must be able to remain alone with the Examiner for up to 2 hours without interruptions or distractions, including television, phones, or people entering and leaving the room. We reserve the right to refuse to conduct the examination if the Examiner determines that the environment is unsuitable or that the requirements for a controlled environment cannot be satisfied. This is necessary to prevent distractions and potential distortion of the test results. All fees paid will be retained.
3.1. Once we have received your completed Pre-Examination Questionnaire and the balance has been paid to the Examiner, we will provide the location of your examination. The Examiner will formulate the test with you at the venue immediately before the examination begins.
3.2. By accepting this agreement, you confirm that you are the authorised cardholder and have permission to make an electronic card payment. You acknowledge that processing this or any other transaction without authorisation constitutes fraud. Lie Detector Test UK accepts no liability for fraudulent activity.
3.3. When making a booking, you make two separate payments. The first is our non-refundable £125 pre-examination assessment fee, which is paid to us and covers the assessment and booking service described above. The second is the applicable remaining balance for the selected test product, which is paid directly to the Examiner. We do not receive or hold this balance.
3.4. We collect the non-refundable £125 pre-examination assessment fee at the time of booking. Once we have received your completed Pre-Examination Questionnaire, the Examiner will arrange payment of the balance directly with you.
3.5. After the non-refundable £125 Pre-Examination Assessment Fee has been paid, you will receive the Pre-Examination Questionnaire by email and SMS. The questionnaire must be returned within 24 hours to support efficient booking arrangements. If the questionnaire is not returned within 24 hours, we reserve the right to cancel the appointment.
3.7. The balance must be paid in full directly to the Examiner at least 48 hours before the scheduled examination. We will contact you before and at the time of this deadline. If you fail to respond during the 48-hour period, the booking will be cancelled. The pre-examination assessment fee will be retained, the Examiner may retain any balance already paid, and the option to rebook will be withdrawn.
3.8. Any additional supporting documentation requested from us must be provided at least 48 hours before the scheduled examination. We will contact you before and at the time of this deadline. Failure to provide the required documentation will result in cancellation of the booking. All fees paid will be retained and the option to rebook will be withdrawn.
3.9. If you wish to change the date of your booking, you must provide at least 48 hours’ notice, and the replacement booking date must fall within 30 days of the original booking date.
3.10. In the event of cancellation, the non-refundable fee referred to in Clause 3.3 may be transferred to another appointment without loss of payment, provided that at least 48 hours’ notice is given before the appointment. Cancellation requests must be sent to [email protected].
3.11. In unforeseen circumstances, where we agree that the 48-hour requirement under Clause 3.7 has been satisfied, you may cancel the scheduled examination and any balance already paid will be refunded by the Examiner. The pre-examination assessment fee remains non-refundable.
3.12. Once the test has been conducted and the results have been provided to the client, no refund will be available regardless of the outcome, including No Deception Indicated, Deception Indicated, or Inconclusive. The results provided are final.
3.13. Failure to comply with any of the Terms of this agreement will result in cancellation of the examination. All fees paid will be retained and the option to rebook will be withdrawn.
3.14. Any payment made under these Terms is final. These Terms take precedence over the terms imposed by your bank, banking institution, or creditor, including but not limited to Mastercard and Visa.
3.15. The examination date must be agreed and scheduled within 30 days of the original booking date. If the client does not agree on an examination date within this period, the booking may be closed and the £125 pre-examination assessment fee will remain non-refundable. Any appointment requested after this period may require a new booking.
3.16. As the balance is paid directly to the Examiner, any refund of the balance must also be issued by the Examiner. If you have any questions regarding the balance, you may contact us at [email protected] and we will raise the matter with the Examiner on your behalf.
3.17. The Online Pre-Examination Assessment begins immediately once the pre-examination assessment fee has been paid. If, after reviewing your questionnaire, we determine that a polygraph examination is not suitable for your case, we will inform you before any Examiner’s fee becomes payable.
4.1. All data, charts, documents, and video recordings remain the property of the Examiner and will be handled in accordance with our obligations under the Data Protection Act 1998:
4.1.1. If you state on the Consent Form at the beginning of your instructions that you want your test data removed once our work has been completed, all data obtained will automatically be deleted after the results have been provided in report form, except for the polygraph results report, which will be retained for one year in accordance with the terms of membership of the American Polygraph Association (APA).
If you do not indicate on the Consent Form that you want your test data removed, all video recordings, voice recordings, and charts held about you will automatically be deleted 24 hours after the report has been produced.
If you state on the Consent Form that the video and voice recording are to be used as evidence in court, a tribunal, or for another legal purpose, your data will be retained for a maximum period of one year. During this period, the video and voice recording remain the property of Lie Detector Test UK.
If you have requested during your pre-test interview that the video be retained, it may be viewed with an Examiner at a controlled office location on an agreed date, subject to payment of our costs, or where requested by a legal body. The video and test data must be interpreted by our Examiner and will not be released except in accordance with the terms above.
You must inform your Examiner during the pre-examination interview if you require such recordings to be retained; otherwise, they will be deleted within 24 hours.
4.1.2. We reserve the right to disclose your personal and/or test data to the police or any other relevant authority or body considered necessary where the results indicate deception connected with allegations of sexual abuse or domestic violence.
5.1. We will not be liable for any failure to perform, delay in performance, or failure to fulfil any of our obligations under these Terms or any other implied terms where such failure or delay results from events beyond our reasonable control.
5.2. An event outside of our control means any act or occurrence that is beyond our reasonable control, including but not limited to:
5.2.1. Lock-outs or other industrial action by a third party.
5.2.2. Civil unrest or commotion.
5.2.3. Riot.
5.2.4. Invasion.
5.2.5. A terrorist attack or threat of a terrorist attack.
5.2.6. War, whether declared or undeclared.
5.2.7. Fire or explosion.
5.2.8. An Act of God, including storm, flood, earthquake, subsidence, epidemic, or another natural disaster.
5.3. If an event outside of our control occurs and affects our ability to fulfil our obligations under these Terms:
5.3.1. We will contact you as soon as reasonably possible to inform you of the situation; and
5.3.2. Our obligations under these Terms will be suspended and excluded for the duration of the relevant event.
5.4. If an event outside of our control occurs, we will confirm with you when the appointment can be fulfilled or arrange an alternative appointment. No refund will be provided as a result of an event outside of our control.
5.5. In unforeseen circumstances that we agree to accept, and where a minimum of 48 hours’ notice has been provided, you may reschedule the polygraph examination within 14 days of the original examination date. We may carry forward your original non-refundable fee to the new booking.
6.1. I confirm that I accept and agree to comply with the above Terms and Conditions. I also confirm that I wish to proceed with the polygraph examination. I am authorised to accept these Terms in full and agree to make the required payment in full and with proper authorisation.
